Safeguards relating to GDPR Data Subject Rights are also subject to SMA's legal obligation not to disclose confidential information pursuant to professional secrecy (see also Article 488 Financial Instruments Market Act). Taking into account the fact that the conditions for obtaining and disclosing confidential and/or personal data are determined in the regulations applicable to SMA, in accordance with point (c) of paragraph (5) of Article 14 of the GDPR, SMA will not provide information to Data Subject in the above cases in accordance with paragraphs 1 to 4 of the same Article of GDPR. SMA may also decide to do so if it obtains personal data from a third country authority or it transmits to third country authorities, in order to prevent the prejudice or harm to supervisory or enforcement function of SMA (e.g. monitoring or assessment of compliance with applicable laws, prevention or investigation of suspected offenses) - ZTFI-1, Article 463 (8).
