Authorization to access auction systems

Commission Regulation 1031/2010 regulates the timing, administration and other aspects of auctioning of greenhouse gas emission allowances based on Directive 2003/87/EC on the establishment of a system for trading greenhouse gas emission rights in the Community. In order to access the auction system of greenhouse gas emission rights, it is necessary to submit an application for access to direct bidding based on Commission Regulation 1031/2010. Based on the first paragraph of Article 2 of the Regulation on the Implementation of the Regulation (EU) on the Auction of Greenhouse Gas Emission Rights (Official Gazette of the Republic of Slovenia, No. 14/14), the ATVP is the competent authority for issuing such an authorization.

A person wishing to obtain authorization for direct access to auction systems must submit a written request to ATVP. The written request must also include evidence in accordance with Article 59 of Commission Regulation 1031/2010.

Persons entitled to submit an application for access to direct bidding at auctions are:

a)    a facility operator or an aircraft operator holding an operator holding account or an aircraft operator holding account and bidding on its own behalf, including a parent, subsidiary or affiliated undertaking that is part of the same group of undertakings as the aircraft operator or operator;

b)    investment companies that have obtained licences in accordance with Directive 2014/65/EU and are bidding on their own behalf or on behalf of their clients;

c)    credit institutions that have obtained licenses in accordance with Directive 2013/36/EU and are bidding on their own behalf or on behalf of their clients;

d)    business associations of persons listed in point a), who bid in their own name and act as representatives of their members;

e)    public bodies or state-owned enterprises of Member States that supervise any of the persons listed in point a).
